Bad Idea: Sending a video of yourself masturbating to her mobile as she is in the police station making a complaint about you stalking her

WHEN Corio man Benjamin Baker sent an obscene video of himself on his mobile phone, he didn’t count on his victim being at the police station when she received it.

The video not only provided police with a first-hand glimpse of what the stalker had been up to, but all the evidence they needed to charge him.

Baker, 27, of Princes Hwy, Corio, pleaded guilty in Geelong Magistrates’ Court yesterday to charges of stalking and using a telecommunications device to harrass.

Police Prosecutor, Senior Constable Seaton Lillas said that between January 1 and January 7 this year Baker repeatedly tried to phone the victim, but she kept missing the calls.

He said that at 9.18pm on January 5, Baker called the victim on his mobile phone using the video call facility.

When she answered, Baker was on film masturbating himself, but the victim did not see what was going on because the screen was too dark.

Sen-Constable Lillas said that on January 6, Baker concealed his number using the anonymous function on his phone and tried, unsuccessfully, to video call the victim eight times within a seven-minute period.

He tried another 15 times in the space of six minutes the following day, and continued to call repeatedly, but the phone was never answered.

“At 7.53 that evening he made another video call to the victim, and this time she answered,” the prosecutor said.

“Baker began videoing himself masturbating and angled the phone’s camera in such a way that only his penis and hand were filmed.

“On seeing this, the victim hung up.”

Sen-Constable Lillas said Baker continued to make anonymous calls to the victim, but unbeknown to him, one of the video calls was made while the woman was at the police station.

“The victim answered the call to find Baker again masturbating himself and she showed the officer taking her statement,” he said.

“Baker denied stalking the victim and said he was ill at the time.”

Magistrate Tim McDonald described Baker’s conduct as disturbing before convicting him and fining him $3000.
